- Auction for rights to excavate stone having become disputed did not become effective –negotiations also failed –licensing authority prdring re-auction but on application of respondents order recalled –and rights given to respondents on specified amount –authority had no power to recall re-auction and granting rights to respondents without associating petitioner malafide.
