Online Division-Wise Distance Learning Training Session for Judges of the District Courts on General Topics Week 1

With the approval of Hon’ble Chief Justice Lahore High Court/ Chairperson BoM, Punjab Judicial Academy, Lahore, the Academy has designed Online Division-Wise Distance Learning Training Session for Judges of the District Courts on General Topics from 11th March, 2024 to 05th September, 2024.

On 11th March, 2024, the training sessions inaugurated with the recitation of Holy Qur’an. In the opening remarks, Mr. Ashtar Abbas, Acting Director General PJA, shared his views that the Academy has designed this online training program on general topics of utmost importance for capacity building of the Judicial Officers in Punjab. The topics included are An Overview of Powers of Appellate Court to Remand a Case or the Remittance of Suit File U/O 41 Rule 23 and 25 CPC, Amendment in Pleadings, Rejection & Return of Plaint: General Principles and Guidelines, Loss of Judicial File and Procedure of its reconstruction in the light of Lahore High Court Rules and Orders, Understanding Land Revenue Laws – Exclusion of Jurisdiction of Civil Court, Introduction to I.T and its importance in Judicial Regime, Law relating to Examination of Witness, Cross-Examination of Witness, Re-Examination and Court Questions in Civil and Criminal Cases, Use of Precedents – How to find ratio decidendi and obiter dicta, The Law relating to Attachment before Judgment under order 38 Rule 5 CPC – General Principles and Guidelines, Child custody – Rights of non-Custodial Parent – Preparation and Implementation of Visitation Schedule, Fixing of Temporary & Permanent Maintenance Allowance and the relevant case laws, Medical Jurisprudence & its Importance in Adjudication: Understanding Medical Legal Reports and DNA Reports – their evidentiary value, Challenges Posed by Climate Change: the relevant Environmental Laws and How to Deal with Challenges by Specialized Environmental Courts, An Overview of Alternate Dispute Resolution (ADR), its Application in Litigation before Courts with reference to latest Amendments, Interpretation of Statute and use of Precedents in Judgment, Production, Impounding and return of Documents, Burden of Proof in Criminal and Civil Cases – Shifting thereof, Cases relating to Gender Based Violence, Consecutive & Concurrent Sentencing and Marshalling of Facts and Evaluation of Evidence in Murder Cases.

Mr. Muhammad Iram Ayaz, Director Training (Distance Learning) PJA, in his inaugural address gave an overview of the program and emphasized that the objectives of the training sessions are to further enhance the judicial and professional skills of the Judges, therefore, it is so important to remain engaged and actively participate in the webinar sessions. Click here for pictures.

The subject of inaugural training session was “Introduction to I.T and its importance in Judicial Regime” addressed by Dr. Imran Mujaddid Rabbani, Instructor IT, PJA, from 11:15 a.m. to 12:30 p.m., attended by Judges from Sahiwal & Sargodha Divisions. Dr. Rabbani delved into the significance of information technology (I.T.) for judges, court staff, and legal professionals. Participants gained insights into digital case management, e-filing, virtual hearings, and the secure handling of electronic evidence. On Tuesday, 12th March, 2024, Hon’ble Mr. Justice (R) Mahmood Maqbool Bajwa conducted a webinar session for the Judges from Bahawalpur & D.G. Khan Divisions on the topic “Law relating to Examination of Witness, Cross-Examination of Witness, Re-Examination and Court Questions in Civil and Criminal Cases”. His lordship highlighted that witness testimonies play a pivotal role in legal proceedings, and understanding the nuances of examining and cross-examining witnesses is essential for justice delivery. During this session, Hon’ble Resource Person delved into the intricacies of witness examination, emphasizing the order of questioning, permissible questions, and the role of the court. On Wednesday, 13th March, 2024, from 11:15 – 12:30 p.m.

Dr. Badriah Khalil, Head of Applied Linguistics Department, Kinnaird College for Women University, Lahore, conducted webinar session for the Judges from Bahawalpur & D.G. Khan Divisions on the topic “Challenges Posed by Climate Change: the relevant Environmental Laws and How to Deal with Challenges by Specialized Environmental Courts”. Dr. Khalil delved into the impact of climate change on extreme events such as forest fires, hurricanes, heatwaves, floods, and storms. She emphasized the role of specialized environmental courts in addressing these challenges. Participants gained insights into relevant environmental laws and rules. On Thursday, 14th March, 2024, Syed Nasir Ali Shah, D&SJ (R), conducted the webinar session for the Judges from Gujrat & Lahore Divisions on the topic “The Law relating to Attachment before Judgment under order 38 Rule 5 CPC – General Principles and Guidelines”. During the webinar, learned Resource Person discussed that the legal provision, governed by Order 38 Rule 5 of the Code of Civil Procedure (CPC), holds immense significance in civil litigation. During the session, participants gained insights into the general principles and guidelines governing attachment before judgment. The learned Resource Person emphasized the conditions for seeking attachment, the role of the court, and the impact on parties involved.
