At the time of passing judgment under Review, the Bench of Supreme Court while considering appeal did not take into consideration implications of a letter, it should have taken into consideration all evidence available on record. Supreme Court recalled its earlier judgment and appeal would be deemed to have been pending. Petition was allowed.
